It is a complex subject, yet you showed a great deal of insight into it and
I enjoyed reading your post. However, I have a couple of comments about the
need to be pragmatic regarding good and evil.
You're right on about good and evil being subjective and the need to take
them in context. Would it have been wrong to murder Hitler in 1938 and save
the world from all the suffering he caused? From a higher perspective there
is no absolute good and evil. In an ideal world everyone should act
according to their own realization of a moral code. (I tend to do that
regardless, but don't tell the authorities)
Yet we don't live in an ideal world. Without a stable government society
degenerates into anarchy -- looting, rape, terrorism. Just look at Iraq.
To insure equal treatment and because judges can't read minds to discover a
person's true intent (that's the fallacy of hate crime laws), good and evil
have to be objectified into a code of law. Sure there will be mistakes and
miscarriages of justice; this isn't utopia. The rule of law is just the
best we've come up with given present human nature.
